Abstract

The purpose of conducting this research is to know how the relationship with the law of funds customer deposits at the bank and how application of the law against embezzlement of funds bank customer deposits. Embezzlement is an act of dishonesty by hiding other people's property by one or more people without the knowledge of the owner of the goods with the aim of transferring, controlling, or using it for other purposes. Embezzlement refers to a form of crime in which a person or entity misuses the trust placed in them. Embezzlement is regulated in Article 372 of the Criminal Code which explains that what is included as embezzlement is the act of taking the property of another person in part or in whole, where the mastery over the goods already exists in the perpetrator, but the control takes place legally. Most embezzlement occurs because of mutual trust between parties. Someone who trusts other people too much because they have known each other for a long time, or because they are influenced by the persuasion of friends who provide references are usually prone to becoming victims of embezzlement. In order to prevent the criminal act of embezzlement of funds in the company, you should take several administrative or civil preventive measures. With one form of prevention that you can try, namely by making a company regulation, work agreement or SOP that is clear and directed by regulating administrative tasks, the game is responsible when the workforce gets the responsibility for holding inventory or office assets. Apart from that, it is better if you also determine and regulate a sanction that will be given if an employee commits an act of embezzlement within the company. You also need to make sure there is supporting evidence when committing embezzlement in the company.
